Analysis of the Realization of the Right of the Government to Protect Employment Boundaries:From the Market Economy Perspective

市场经济国家政府有保障公民就业权实现的职责,就业权的自由权为主导、并兼具社会权的性质决定了政府在保障公民就业权实现时应该有所为,有所不为,以遵循市场经济规律为基础保障公民就业自由权的实现,以弥补市场运行中存在的缺陷为基础保障公民就业的社会权的实现。政府通过适当干预,使本国公民能够有尊严的生活,实现其生存权和发展权,最终实现社会的实质公平和公正。

In the market economy, governments have the responsibilities of guaranteeing citizens~ right to employment. The right to employment is led by freedom right and also has social rights. The nature of the right to employment determines that the government should do something more important by leaving the others undone when protecting the employment rights of citizens to follow the rules of market economy and make up for the defects existing in the market, and then achieve the employment rights of citizens. Government should make appropriate intervention, so that their citizens can live in dignity and realize their right to life and the right to development, and ultimately achieve real social fairness and justice.
