从行政法视角看档案行政主体义务转嫁问题

On the Obligation Shift of Subject of Archives Administration from a Perspective of Administrative Law

档案领域现行"局馆合一"体制造成了行政管理主体与某些行政管理相对人同为一体的情况,档案行政管理主体在处理与综合档案馆相关的行政管理事务时,极易出现立场性"义务转嫁"。在没有法律依据情况下的"义务转嫁",在增加行政相对人负担、影响行政相对人利益的同时,也会给行政主体造成负面影响,损害政府与行政相对人之间的关系,导致政府公信力下降,法律法规的严肃性、权威性受到破坏。因此,根据依法行政的要求,并且从行政法的视角看,档案行政主体的"义务转嫁"必须得到约束与改正。

In the current integrated Archives -Bureau system, the administrator plays a dual rote as Dotn me SUDJeC~ oI aommlstrauon and its administrative counterpart. Therefore, when the subject of archives administration deals with general administrative affairs relat- ed to comprehensive archives, there always exists an obligation shift. This article conducts an extensive analysis on the obligation shift present in the subject of archives administration from a perspective of administrative law.
