摘要 研究目的:分析并协调解决土地抵押权保障和闲置土地监管的冲突,促进节约集约用地。研究方法:理论与实证分析。研究结果:土地抵押权设定和保护有利于地尽其利,闲置土地监管着力解决地尽其用,二者在土地抵押权设立条件、限制土地收回及收回补偿等方面存在冲突。研究结论:遵循兼顾资产流动和促进用地、公共利益优先、信赖保护、参与救济、物上代位等原则,加强土地供后监管、严防新增限制土地;规范土地登记、促进土地金融信息共享;积极制度创新,防控闲置土地处置风险;准确认定事实,依法处置闲置土地。 The purpose of the paper is to analyze and treat the conflict in the land mortgage guarantee and the supervision of the idle land,aiming to achieve economic and efficient land use.Methods employed include theoretical analysis and empirical approach.The results show that the setting and the protection of the land mortgage are beneficial for ensuring land maximum utilization.Meanwhile,the supervision of idle land tries to resolve the inefficient utilization of land.Therefore conflicts exist between the two activities.The results show that it is necessary to follow and consider the principles of assets liquidity,efficiency of land use,priority of public interest,protection of credit benefit,participation in relief,and subrogation.The paper concludes that the countermeasures should be strengthened,such as supervision of land use and strictly preventing additional idle land;regulating land registration and promoting information sharing;actively innovating land institutions,preventing and controlling the risk of handling idle land;and treat idle land conflicts in terms of fact.
