逻辑自洽——香港与深圳土地出让关键制度比较研究

Logical Consistency: the Comparison of Land Use Right Conveyance Between Hong Kong and Shenzhen

研究目的:以土地招拍挂为例,通过香港与深圳土地出让中关键制度的比较研究,深入分析两地制度设计理念和操作方式的差异,提出土地出让制度优化建议。研究方法:比较分析法。研究结果:香港清晰、透明、可预期的勾地制度,贯穿土地出让全过程的卖地合约制度,以及体现契约精神的合约完成证明书制度,环环相扣,不仅降低土地交易成本,而且充分实现土地价值,最大限度地激发土地受让人依约使用土地的积极性。研究结论:建议进一步优化土地出让公告制度,改进土地出让底价定价策略和土地出让启动程序,并围绕土地使用权出让合同进行"契约式"的土地出让制度设计。

The purpose of this paper is to compare the land use right conveyance between Hong Kong and Shenzhen,aiming to provide a policy reference for land transfer in China's Mainland.Comparative analysis is employed.The result shows that clear procedures of land transfer can decrease transaction cost.Complete contract and certificate of land conveyance are critical for the land sale in Hong Kong because it can impel the land user to comply with the contract.The paper concludes that the pre-announcement of land sale scheme is necessary for land transfer in China's Mainland.Land sale pricing and the initiating procedure need to be modified,which should be the core of the policy design of land transfer.
