我国政府采购法中集中采购的若干问题探讨

Problems in Centralized Purchasing Regulated by Chinese Government Procurement Law

政府采购制度是市场经济发展的产物,是公共财政发展的要求。目前,我国政府集中采购方面存在着的突出问题是集中采购的法律地位不明确;集中采购机构概念不清;隶属关系及监管关系混乱;法定职权被弱化;采购范围小。完善集中采购制度,应坚持以集中采购机构为主体的发展方向,明确政府集中采购机构的功能定位,理顺集中采购机构与监管部门的职责关系,并适当扩大集中采购的范围。

A government procurement system is the developmental outcome of market economy and the requirement of developing public finance. However, centralized government procurement now has some problems in terms of the undefined legal status of centralized procurement, unspecific procurement departments, chaotic subordination and supervision relations, weakened legitimate authority, and the small purchasing scope. To improve the centralized procurement system, we should keep focusing on purchasing departments, specify the function of government purchasing departments, define the duty relations between purchasing departments and supervision departments, and expand the purchasing extent properly.
