刑事二审审理方式的改革与完善

Reform and Perfection of the Mode of Trial inthe Second Instance

新刑诉法对二审审理方式的规定进行了修改,为提高二审开庭率,增强二审程序的公正性提供了可能。但修改后的二审审理方式依然存在问题。从立法规定层面看,新刑诉法对二审审理方式选择标准的确定,难以体现刑事诉讼规制职权与保障权利的基本精神。应着眼于以规范职权和保障权利为基本原则,通过司法解释明确二审审理方式的选择标准对其予以进一步完善。从司法实践层面来看,现有的配套制度和措施与扩大二审开庭范围的要求不相适应。需要通过进一步的制度和机制改革,实现二审开庭的常态化和实质化。

The provisions of the mode of trial in the second instance have been reformed in the new criminal procedure law,which is helpful to enlarge the scope of court sessions and strengthen the fairness of the second instance.However,there are also some problems after the provisions are modified.From the perspective of legislation,the standard of the mode in the second instance does not comply with the idea of power regulation and right protection,which should be adopted to clarify the standard of the mode in the second instance by making judicial interpretation.From the perspective of judicial practice,the supporting systems and measures which related to the mode of trial in the second instance do not comply with the requirement to enlarge the scope of court sessions.So it is supposed to reform and make the trial of the second instance more normal and substantial.
