摘要
近年来在中国法院体制内自上而下建立专门审判管理机构和设立案件质量评估指标体系的探索,是对同步进行的世界性的案件管理运动的积极回应。但是,通过对案件质量评估指标体系中所确定的审判公正指标之陪审率、审判效果指标之调解率、审判效率指标之简易程序适用率以及审限内审结率的实务观察与分析,不难看出,如此的案件管理机制是否真的提升了中国民事司法的品质及公信度,仍是有待考究的。因此,应审慎处理案件质量评估体系与法院评先创优的关系,应变关注提高速度为关注提升品质,同时在案件管理中还应当关注当事人及其诉讼代理人主体作用的发挥。
Exploration of the establishment of special case management organization from top to bottom in the court system of China and the implement of case quality evaluation index mechanism is a positive reaction to the contemporary worldwide case management movement. However, it remains to be seen whether the cur- rent mechanism is better realized the judicial justice and efficiency and enhanced the quality and accountability of judicature based on the observation and analysis on the rate of people assessor joining the collegial panel to hear the case, the rate of resolving case by judge mediation, the rate of applying of the simplified procedure to hear the case, and the rate of termination of litigation in the time limit. It should be cautious to deal with the relationship of the index mechanism and the selection of advanced court or judge with honors and rewarding. It's worthwhile to shift focus from the initiative of litigants and their speeding agent ad up the litigation to a better qualified of judicature with attention to litem.
