A critical legal analysis on the legal status of guidelines for implementation of WHO Framework Convention on Tobacco Control

《烟草控制框架公约》缔约方会议迄今已通过公约下七个条款的实施指南。公约实施指南是否具有法律约束力,社会各界存在模糊认识。本文拟从条约内涵角度,结合实施指南的特征,综合分析论证公约实施指南不是条约,没有法律约束力。

Conference of the Parties of Framework Convention on Tobacco Control has adopted guidelines for implementation of 7 provisions to the Convention.With regards to the legal status of these guidelines,misunderstanding exists.The objective of this paper is to analyze the legal status of these guidelines on the basis of definition and legal characteristics of Treaties and by taking account of the characteristics of these guidelines.Conclusion is made that guidelines for implementing the Convention are non-legally binding and hence cannot be regarded as a Treaty.
