An analysis on the pending issues in the Provisions of the Supreme People's Court on Several Issues Concerning the Trial of Cases of Disputes over Marine Freight Forwarding

对《最高人民法院关于审理海上货运代理纠纷案件若干问题的规定》中的相关争议问题进行了分析,针对第7条拒绝交付单证、第8条单证交付请求权、第11条相应赔偿责任及第12条连带赔偿责任等规定,提出了相应的观点。

This paper does an in-depth analysis of the pending issues in the Provisions of the Supreme People＇s Court on Sever- al Issues Concerning the Trial of Cases of Disputes over Marine Freight Forwarding. The issues include Article 7 of detention of documents, Article 8 of delivery of transport documents, Article 11 of the corresponding liability to the principal of the freight forwarder and Article 12 of the joint and several liability of the freight forwarder who issued the bill of lading on the behalf of the unqualified NVOCC.
