论江西省科技创新的法律促进机制的不足及完善

Legal Promotion Mechanism on Scientific and Technological Innovation in Jiangxi Province

良好的法律机制是促进科技创新的重要前提。近年来,江西省各级政府及相关部门都出台了法律法规鼓励、引导企业科技创新,以科技创新能力的提升推动地方经济进步,江西省科技创新的促进机制得到一定程度的增强。但与此同时仍存在一些问题:企业科技成果转化不足、科技融资存在困难、税收激励不太完善以及权利救济渠道不畅通。本文认为,应以鄱阳湖生态经济区的建设为契机,依法确认企业的科技创新主体地位及各项权益,严格实施促进科技创新的税收法律,完善科技创新融资体系,赋予科技创新主体充分的法律救济途径,综合运用多种手段促进科技创新。

Complete legal mechanism is an important basic for the promotion of scientific and of technological innovation. The promotion of technological innovation mechanism was improved in Jiangxi Province in recent years. Governments and relevant departments have made laws and regulations to encourage and guide enterprises to implement technological innovation. However, there is a series of constraints of technological innovation which include Scientific and Technological Achievements Transfer Sparingly, technology financing difficulties, defective policy of tax of incentive and incomplete right relief system. This article argues that the construction of Poyang Lake Ecological Economic Zone is an important opportunity and focus on four aspects： to confirm enterprise as the dominant position and the rights of technological innovation according to law, strictly enforce the tax laws to promote technological innovation, improve the financing system and the right relief system of scientific and technoiogical innovation, to promote the ability of enterprises＇ technological innovation.
