专利法的低碳观及其对技术创新的影响研究

The Low-carbon Values of the Patent Law and Their Influence on Technological Innovation

基于低碳发展的时代紧迫性,有必要对专利法的传统价值观根据经济发展模式的转变而进行适当调整。研究了专利制度产生的经济基础以及由此确立的价值观,得出专利法价值观因经济技术发展而变的基本结论。系统梳理低碳发展的经济转型及新发展模式对专利法的需求与影响,初步提出适应低碳发展的专利法价值观及其具体制度体系。

Since the way of economic development has moved to low-carbon,it is high time the traditional values of patent law changed on the basis of the new pattern of economic development.This paper studies the economic basis of the patent system and the resulting values,and concludes that the values of patent law change along with the economic and technological development.In this paper,we summed up the demand for and impact on patent law during the low-carbon economic transition and a new development model of economy.Then we proposed a new preliminary value and specific system of patent law to adapt to the low-carbon development.
