摘要
关于职务作品著作权的归属,我国著作权法在区分一般职务作品和特殊职务作品的基础上分别予以规定。但在劳务派遣的情形下,由于其三方主体间的特殊关系,如果严格遵循著作权法中关于职务作品著作权归属分配的规定,就会在劳务派遣单位与用工单位之间产生争议。如何解决这种冲突,使劳务派遣中职务作品的归属得以明晰,可以在明确三方主体间法律关系性质的基础上对现行著作权法做出相应的补充和修正。
Ownership of copyright works on post,China's copyright law works in the distinction between general and specific job duties based on the works to be provided separately.But in the case of dispatch,because of its special relationship between the main three parties,if strictly follow the copyright law ownership of copyright in works created on the provisions of the distribution,it will dispatch units and employment in the labor dispute between the units.How to resolve this conflict,so that dispatch can be in the clear ownership of work created,you can clear the nature of the legal relationship between the main three parties on the basis of the existing copyright law to make the appropriate additions and amendments.
