论电子病历的证据价值及其实现依据

On the Evidential Value and Realization Basis of Electronic Medical Records

本文在简介我国电子病历推行现状的基础上，主要从电子病历的电子签名、改动痕迹保留和时间戳等技术的运用来阐述电子病历符合证据的真实性特征，从电子病历是关于患者病情、诊断和治疗等信息的记录的角度来论速电子病历符合证据的关联性特征，从通过设定电子签名权限以确保书写者身份的合法性来论述电子病历符合证据的合法性特征。

On the basis of a brief introduction of the implement status of electronic medical records in China,this paper discusses the characteristics of authenticity from the electronic signature of electronic medical record, the retaining of change marks, and the use of time stamps; discusses the characteristics of relevance on the basis of the idea that electronic medical record is about the information record of patient＇s condition, diagnosis and treatment, etc.; and discusses the characteristics of legitimacy from the ensurance of the legitimacy of signer＇s identity by setting the electronic signature authority.
