摘要
个人或家庭在消费金融市场通过选择金融机构提供的金融产品实现一生的最大化效用,金融消费者保护是在消费金融市场规制过程中对于个人权益的着重强调,其经济合理性在于市场效率的实现和出于自由父爱主义的考虑。对于刚刚起步并逐渐发展的中国消费金融市场,金融消费者保护在理论研究拓展、立法与纠纷处理机制、金融消费者教育以及金融消费者保护机构的组织和协调等方面存在亟须解决的问题。
Financial consumer protection is the application of regulation in the consumer financial market. Individuals or households choose financial product in consumer financial market in order to maximize utility in a life time. The rational for financial consumer protection lies in the market failure and libertarian paternalism. Consumer financial market is in rapid development and become more and more significant for the real economy in China. Attention should be paid to consumer financial study, financial consumer education, financial consumer regulation and Institution governance.
