On the Intellectual Property Protection of PCB Layout Design

印刷电路板在信息产业中起着承上启下整合高低端电子产品的重要作用。印刷电路板布图设计虽然具有与知识产权保护客体相似的品性,但目前仍处于TRIPs协议和国内外知识产权法律保护的真空地带,实践中的案件由于缺少明确的法律依据引起极大争议,欲解决此问题可考虑完善单行法的具体规定并综合运用或通过制定专门条例予以规定。

Printed Circuit Board （PCB） takes an important role in information industry as a connecting link between the high - preceding and the low - following electronic production. But PCB layout design is lack of the protection of Intellectual Property Laws not only in domestic and overseas but also in TRIPs nowadays, even though it meets the requirements of Intellectual Property＇ s subject. As a result, the cases related to PCB layout design are in hot dispute. This thesis discusses the issues of Intellectual Property protection way of PCB layout design, and advises modifying the articles of Intel-lectual Property Laws and applying them integrally, or enacting a specialized regulation on PCB layout design.
