检察机关对民事执行活动监督范围和方式探析

由于现行立法的模糊及最高法的限制性司法解释,使检察机关对民事执行活动监督一度陷入瓶颈。民诉法修正案将执行监督纳入检察监督的范围,使检察机关对民事执行的监督权有法可依,对如何完善检察机关对民事执行活动监督的范围和方式,提出:检察机关对民事执行的监督范围应不受限制;监督方式以抗诉和检察建议为主要方式;对法院的民事执行活动要进行深度参与。

The supervision of procuratorial organs to civil execution was once stuck because of the fuzziness of current legis- lation and the restrictive judicial interpretation of the highest law. Civil Procedure Amendments fit supervision execution into the scope of procuratorial supervision, therefore there are laws to abide by when procuratorial organs monitoring civil execution. The author proposes the ways of improving the scope and manners of procuratorial organs supervising civil execution： the supervision range should be unrestricted; the major supervision manners should be demurrer and procuratorial advice; deeply participate the civil execution of court.
