Military criminal law occupies an important position in national penal system and military law system.Military criminal law has its own unique value pursuit and form of operation.The article discusses the lack of its own concept caused by the dual attributes of criminal law and military law and the problems caused by value conflict existing in military criminal law and criminal law theory,and then puts forward measures for perfection through spirit of the legislation,existing stylistic rules,and legal philosophy combined with the reality of our country.
