摘要
在理论界,关于劳务派遣制度的劳动关系性质存在争议,主要有一重劳动关系说与双重特殊劳动关系说。其中,一重劳动关系双层运行说更应获得肯定,但是该说代理理论的应用值得商榷。在对劳务派遣制度性质合理选择的基础上,反思各学说的责任分配模式和现行立法中的连带责任制度,提出责任区分制度的构建。
There still exists dispute about the labor relation character of labor dispatch system in theory fields.Single labor relationship and double labor relationship are largely accepted.Double theory in labor relations is basically agreed with,but the application of agency theory in this theory is objected.On the basis of reasonable election of labor dispatch's character,various doctrines' responsibility assignment patterns and several liability systems in current legislation are reflected.The construction of distinguishing responsibility system is put forward.
