试论我国刑法第285条计算机犯罪的立法完善

在信息化时代,计算机犯罪日益猖獗。我国现行的刑法对计算机犯罪的规定已不能满足打击计算机犯罪的需要。我国刑法中最能体现打击计算机犯罪的是第285条,并且《刑法修正案七》在原有的基础上也对计算机犯罪进行了补充和完善,但是漏洞和不足仍然存在。因此,需要对我国刑法第285条计算机犯罪的立法加以完善。

In the information age, computer crime has become increasingly rampant. Provisions of our current criminal law on computer crime can no longer meet the needs of fight against computer crime. Although Article 285 is mainly about comba- ting computer--related crime, and the Criminal Law Amendment which is on the original basis of computer crime is supple- ment and perfect, there are still loopholes and deficiencies. Therefore, we have to perfect the computer crime legislation in arti- cle 285 of the Criminal Law.
