摘要
作为全国城乡统筹综合配套改革试验区,重庆市围绕宅基地确权流转做了很多有益的尝试。在梳理国内有关农村宅基地确权证书抵押的研究与实践的基础上,阐述宅基地确权证书抵押的意义与作用,并基于重庆市改革背景,在不改变现行农村土地制度的前提下,运用归纳演绎的方法,探讨农村宅基地确权证书抵押制度的设计。同时,从抵押主体机制、宅基地价值评估机制、抵押行为机制以及风险控制机制四个方面阐述宅基地确权证书抵押机制的内容,并对制度发展完善提出了政策建议。
As the National Urban-Rural Coordinated and Synthetically Reforming Testing District,Chongqing has made instructive attempts on confirmation and circulation of rural residential land use right.This article is to discuss and design the mortgage mechanism of rural homestead right certification for rural lands in Chongqing without changing the current system in inductive-deductive method.The mortgage mechanism for rural homestead right certification includes four parts: roles involved in mortgage,valuation of rural homestead,mortgage procedure and risk controlling.Some suggestions to perfect the mechanism are also promoted in this article.The mortgage of homestead right certification will do good to improve the rural financial system and balance the urban and rural development.
