摘要
《专利法》及其《实施细则》在2008年和2010年相继修订之后,虽然对专利权限制制度的相关条款进行了一定的修缮,但仍然存在诸多不足。通过比较研究其他国家的立法和司法实践,在立足于我国国情的基础上借鉴其成功经验,以进一步完善我国的专利权限制制度,对于促进专利权人、专利权利益相关者和社会公众之间达成利益平衡,意义十分重大。
Patent law and its detail rules of implementation have been successively revised in 2008 and 2010. Although some related terms of the restrictions of patent system have been modified, there are still have many shortcomings. It is of great sense to improve patent restrictions of China for keeping balance among patentee, patent rights stakeholders and the public interest through a comparative study of other countries＇ legislation and judicial practice, drawing lessons from its successful experience on the basis of the national conditions of China.
