摘要
阐述商标使用许可是商标使用的主要方式之一,我国商标许可方式包括普通许可、独占许可及排他许可三种。指出"王老吉"案件的发生,折射出我国法律在商标许可方面的不足,引发了人们关于商标所有人与被许可人价值创造及权利如何分享的法学思考。论述添附中的加工规则,涉及权属界定和利益分配两重问题,这与商标许可中存在的问题类似,可供完善商标知识产权制度参考。
Licensing is among the major commercial usages of trade marks, and in China there are regular licensing, exclusive licensing and sole licensing. The trade mark case of Wanglaoji not only reflects the immaturity of current legal system in terms of trade marks, but also provokes thoughts publicly on the benefit-sharing between trademark owners and licensors. The workmanship rule in Accessio Rules involves the definition of ownership and benefit distribution, and it can be served as a proper reference because of its In'eat resemblance to the case of trade mark licensing.
