论我国慈善组织法人管理弊端及完善途径

On the Malpractice and Its Improvement of Legal Person Management of Charitable Organizations

法人人格不独立是制约慈善组织管理与发展的根本弊端。计划经济的传统影响、法人分类不合理、双重管理体制等是造成此种弊端的原因。对于慈善组织法人管理,政府应放松管制,转向宏观管理和外部监督。提高立法位阶、建立统一的慈善组织登记管理部门、建立慈善性公益法人制度、提高慈善组织内部治理能力等是完善慈善组织法人管理的必要途径。

Not-independent legal personality is the fundamental defects in the management and development of charitable organizations. And the traditional influences such as the planned economy, the unreasonable legal classification and the dual management system caused the status quo of charitable organizations. Hence,the government should deregulate itself for macro and external regulation. To improve the management of charitable organizations, we need to upgrade the rank of legislation, establish a unified registration department for charitable organizations, build a charitable public-welfare legal person system and improve the internal governance of charitable organizations.
