电子法庭与传统民事诉讼法理的冲突与协调

E-court and the Theory of Traditional Civil Suit: Conflict and Coordination

电子法庭是顺应历史和社会进步、经济和科技发展要求的必然产物。虽然在理论上,电子法庭与传统法庭存在众多的冲突,但这些冲突多数是由于人们对传统理论的理解上人为的、武断性的缩小化解释造成的。在实践中,将各种现存的技术手段和将来即将会出现的技术手段合理地运用到我国的电子诉讼中,规避人们想当然的、认为存在的理论冲突,仍然是可能的。在具体使用电子法庭方面,我国领土面积大、东西部经济发展水平不同,地区差异显著,再加上人口众多、民族传统理念的差异以及人口文化水平的不同,我国在适用电子法庭时,必须因地制宜,注重个性。只有结合各种不同的情况,才可能将传统法庭与电子法庭两者的优势都发挥到最大化。

E-court is a natural outcome of human historical and social progress as well as economic and technological development. Despite the fact that there are conflicts between E-court and traditional court theoretically, the majority of them are caused by the one-sided understanding of the traditional theory. In fact, it is still possible to avoid the theoretical conflicts taken for granted by appropriately applying the existing technologies and future technologies to China＇s electronic litigation in practice. Considering China＇s large territory, economic disparity between eastern and western regions and among different districts, large population, different ethics of various ethnic groups as well as different educational levels of people, great attention must be paid on the regional characteristics and conditions when E-court is used. Only when different conditions and situations are considered comprehensively, can the advantages of traditional court and e-court be maximized.
