摘要
《土地管理法》的修改和《集体土地征收补偿条例》的制定,须解决好一系列重要的制度设计问题。这其中包括:通过比例原则进一步限缩征地范围,构建经营性建设用地市场取得机制,确立管制性征收制度规范土地用途管制,明确房地一体征收、分别补偿制度,通过协议价购程序弱化征地强制性,构建征地无效与失效制度以遏制权力滥用,通过补偿方式创新构建起长效补偿机制,建立先补偿后腾地的事前补偿机制,确立司法最终救济的征收解纷机制。
The modification of Land Administration Law and formulation of Collective Land Levy Compensation Regulations require solving a series of important system design problems,including: further limiting the scope of land requisition through'proportion principle';constructing'business construction land'market accession mechanism;establishing control collection system to regulate land use control;to clear the'real estate one collection,compensation respectively'system,weakening land requisition mandatory through'contracted purchasing procedures';constructing land requisition invalid and failure system to contain power abuse;building up long-term compensation mechanism through compensation mode innovation to establish a prior compensation mechanism and establishing a'judicial final relief'collection remedy mechanism.
