从社会性别平等的角度完善我国婚姻家庭立法——以夫妻财产若干规定为中心

Perfection of our Country’s Marriage and Family Law from the Angle of Social Gender Equality——Husband and Wife’s Property Regulations as the Centre

建国后,以国家政权强制推动的妇女解放运动,目标是实现无性别差异的男女平等,但1950年《婚姻法》关于夫妻财产的规定侧重于保护妇女权益,体现了性别差异的平等观。现行婚姻家庭立法欠缺社会性别意识,表面上性别平等的夫妻财产规定在适用中产生男女权益失衡的法律后果。这是否是立法的倒退?我国现行婚姻家庭立法应采用社会性别分析方法,从社会性别平等的角度修改和完善夫妻财产的若干规定,以实现实质意义的男女平等。

After the foundation of the People＇s Republic of China, the goal of women＇s liberation movement drove compulsively by state power is to realize no gender difference in the equality of men and women, but the provisions of couple＇s property in 1950 Marriage Law reflected gender difference equality idea. Couple＇s property provisions in current Marriage Law lack eonsideration of social gender element, the provisions which reflect gender equality on the surface may produce imbalance rights legal consequence between men and women. Is legislation back or not？ It is necessary to adopt social gender analysis method in our country＇s marriage and family legislation, modify and perfect couple＇s property provisions from the angle of social gender equality, so as to realize equality of men and women in material meaning.
