“活的法律”的讲述者——教师在中国法制史课程中的作用

Narrator of the "Living Law": On the Function of the Teachers of the Course of "Chinese Legal History"

由于现有的中国法制史教材对"活的法律"不够关注,作为中国法制史课程的教师,必须做一个"活的法律"的讲述者,不仅应当讲述历史上法律是怎样规定的,更应当讲解历史上法律是如何实施的,唯有如此,才能向学生展现中国法制史的真实全貌。

The existing Chinese legal history textbooks do not pay enough attention on the ＂Living Law＂. The teachers of the Chinese legal history course must be the narrators of ＂living law＂, should not only tell the students how the laws were prescribed in history, but also explain how law was implemented in history, thus the real situation of Chinese legal history could be demonstrated to the students.
