从法美学的角度看先秦子学中的和谐思想

Views on the Idea of Harmony in Pre-Qin Philosophers’ Study from the Perspective of the Aesthetics of Law

中国传统法律文化一直以和谐为理念,和谐思想深深地蕴藏在中国古代社会各个层面当中。和谐并不仅仅是一种社会层面的概念,而且是一种美的体现与表达。先秦诸子的思想中,无不阐发着对和谐之美的追求与向往。固然先秦诸子对具体的和谐态势的理解存在着一定的差异与矛盾,但他们都是追求自己眼中的和谐之美的。在全面建设小康社会、构建社会主义和谐社会的今天,应当从先秦子学的和谐理念当中去糟取精,为和谐社会的建设提供有益的借鉴。

The idea of harmony has been pursued by the traditional culture of law in China, and it＇s deeply rooted in all aspects of society in ancient China. Harmony is not only a social concept, but also the embodiment and expression of beauty. The thoughts of pre-Qin philoso- phers, all without exception, exposes their pursuit and yearning for the beauty＇of harmony. Although there are diHerences and conflicts in the pre-Qin philosophers understanding of spe- cific harmonious situations, they are pursuing the beauty of harmony in their own ＂eyes. In the comprehensive construction of the well-off society and socialist harmonious society, our 9arty advocates the importance of harmony. We should extract essence from the pre-Qin concept of harmony to provide useful reference for the construction of our harmonious society.
