我国《治安管理处罚法》对扰乱公共秩序的行为作了比较明确的规定,有的规定比较具体,但有的规定却具有一定的原则性和抽象性。许多现行法规、规章以及规范性文件都有关于公共场所秩序的禁止性规定。但在实践中,对一些违反上述禁止性规定的行为是否构成扰乱公共场所秩序行为,能否给予治安处罚以及如何处罚存在较大争议。应在厘清相关概念的基础上做进一步探讨,以更好地规范执法和维护社会秩序。

The Law of the PRC on Public Security Administration has clear regulations about the behaviors disturbing public orders.Some of the regulations are specific while others are Abstract.Many current laws,rules and regulatory documents have the regulations about the prohibition in public places.In practice,however,there're a lot of arguments about whether the behaviors against the prohibition are the defences disrupting public place order and whether or how they can be punished.A further discussion should be done on the base of defining related concepts,so that the law-enforcement can be better standardized and the social order can be better maintained.
