论剥夺政治权利内容的不确定性——基于学说述评及规范文本分析视角

On the Uncertainties of Deprivation of Political Rights——In perspective of theoretical reviews and analyses of prescriptive texts

剥夺政治权利的内容是不确定的,这种不确定性表现在三个方面,即学界对《刑法》规定的剥夺政治权利内容的阐释存在诸多差异甚至是针锋相对;历史上不同时期的规范性文件规定的剥夺政治权利或相类似刑罚方法的内容不一致;被剥夺政治权利者除在刑罚执行期间丧失《刑法》规定的权利之外,还将在刑罚执行期间及之后一定时间内甚至终身丧失其他一些内容广泛、性质多样的非政治权利。

The Contents of the Deprivation of Political Rights （DPR） are uncertain. Those uncertainties are embodied in three aspects： （1） the different or opposite scholar interpretations of DPR contents prescribed in the Criminal Law; （2） the contents of DPR or like punishment stipulated differently in the prescriptive texts enacted in different historical periods; （3） the extensive and variable non-political rights of which the punished is deprived during the term of criminal punishment and/or certain time after the term, sometimes life-long, in addition to his deprivation of the rights prescribed by the Criminal Law within the criminal punishment term.
