摘要
随着我国高等教育扩招和收费制度的实施,越来越多的高校学生选择了参加社会有偿劳动。高校大学生从事社会有偿劳动的形式主要有勤工助学、实习和自主打工三种。由于大学生的三种有偿劳动在性质上有重大区别,所以在保护学生不同劳动的权益时,应依上述劳动类型的不同,分别采用行政法调整、劳动法调整和民法调整三种不同的保护方法。
With the implementation of China’s higher education enrollment expansion policy and charging system,more and more college students choose to participate in the social paid work.College students engage in paid labor mainly in the form of work-study,internship and independent work.And due to the significant differences among these three kinds of paid labor in nature,three different legal regulative methods for protection,i.e.administrative law method,labor law method and civil law method,should be applied respectively according to the types of labor to protect the rights and interests of students.
