摘要
教育矛盾纠纷第三方调解是个全新的概念,通过揭示教育矛盾纠纷第三方调解的基本内涵和特征,从解决教育矛盾纠纷的复杂性与原有解纷机制的局限性出发,阐释构建教育矛盾纠纷第三方调解机制在提高效率、缓解诉讼压力、实现实质正义、营造教育和谐等方面的重要作用。同时,为解决构建教育矛盾纠纷第三方调解机制过程中出现的机构设置与人员组成、受案范围划定、经费来源和调解程序等难点问题提出了有建设性的意见和建议。
This paper defines the new concept of the mechanism construction of the third-party mediation in education- al conflicts and disputes. Furthermore, it reveals the important effect of this mechanism construction in increasing efficien- cy, realizing substantive justice and creating harmonious education. The constructive comments and suggestions are proposed to resolve the difficult problems in the construction of the third-party mediation mechanism in educational conflicts and dis- putes, such as the institutional setting, the staff composition, designating the range of the case, the sources of funding and the mediation process.
