关于社区矫正问题的实践研究——以石家庄市为例

The Study on the Practices of Community Correction: Take Shijiazhuang as an Example

社区矫正制度是西方国家一种新型的刑罚执行措施,它体现了刑罚执行制度由严趋宽的国际趋势。在促进罪犯重返社会、避免罪犯交叉感染和合理配置行刑资源等方面有着重要意义。我国自2003年开展社区矫正试点后,2005年1月河北省作为第二批试点省份,开展了社区矫正试点工作。以石家庄市为例,通过对社区矫正工作开展现状进行调查和研究,发现还存在以下几方面的问题:社区矫正工作法律制度和经费保障制度的缺失、执法主体不明确、各部门工作衔接不畅等。针对所存的问题,提出了以下几点建议:完善制度体系,提供法律保障;改革机构建制,明确执法主体;健全矫正工作队伍,提高矫正工作人员综合素质;加大社区矫正宣传力度,提高社区群众认同度。

Community correction system is a new penalty enforcement measure in western countries. It reflects the international trend of the penalty system which changes from strict to tolerant, and has great significance in promoting the returning of criminals to the society, avoiding the interaction of criminals and allocating execution resources rationally. Since China began to carry out the community correction in 2003, Hebei began to implement community correction in January 2005 as the second batch of pilot provinces. Based on the investigation and study on the community correction status in Shijiazhuang, there exist some problems such as the lack of community correction legal system and fund ensuring system, ambiguous law enforcement entities and imperfect cooperation between different departments. For solving existed problems, we should improve the institutional system, provide legal protection; reform agencies, clarify law enforcement body; perfect correction work force, improve the overall quality of the correction staff; increase community corrections propaganda, and arouse the public recognition of community correction.
