摘要
自2007年6月我国《劳动合同法》颁布以来,理论界和实务界对该法第二十条涵义的争论就没有停止过,虽然2008年9月国务院颁布的《劳动合同法实施条例》第十五条对《劳动合同法》第二十条进行了解释,但关于《劳动合同法》第二十条的涵义依然缺乏统一、权威的界定。在此指出关于第二十条涵义存在的争议,并从不同方面对第二十条的涵义进行分析与界定,最后提出条文修改之立法拙见。
Since our country enacted "labor contract law" in June 2007, the controversy on the twentieth article never stop from theory circle to practice circle. Although the article 15 of the "regulation on implementation of labor contract law" explained the article 20 of the "labor contract law" in September 2008, there is still lack of Authoritative and unified definition. Based on the analysis and definition of the twentieth article, this paper puts forward revised suggestions.
