体育领域授权立法研究——对相关研究剖析及进一步思考

体育领域授权立法问题研究较少,通过对相关研究提出的观点进行辨析,认为应该承认职权立法的存在,取消默示授权立法。在此基础上对整个体育领域授权立法现象进行了分析,发现了一些诸如越权授权、多级授权和监督机制不完善等新问题,认为应该坚持法制统一原则,不断完善授权法内容以及强化监督制度。

At present, researches on delegated legislation in the sports field are scarce. This paper proposed that au- thority legislation should be admitted and implying delegated legislation should be cancelled. Analysis of the delegat- ed legislation in the sports field showed that there were delegated legislation beyond authority, multi-level delegated legislation and imperfect supervising system. In order to solve these problems, the law system should be unified, contents of delegated law should be bettered and supervising system should be reinforced.
