实施消防备案抽查存在问题探讨

On the Practice of the Selective Examination of Fire Projects Kept on Records in Buildings Being Constructed

新《消防法》缩小了消防行政许可范围,改为对大部分建设工程实施备案抽查。这在一定程度上缓解了社会群众日益增加的消防安全需求与消防监督管理不到位的矛盾,但同时也带来了相当一部分场所失控漏管的问题。采用竣工验收代替备案抽查的制度,能够较好地解决备案抽查与失控漏管的矛盾,对我国消防工作的制度设定具有一定的借鉴意义。

The latest fire law put strict limits on the fire administrative permission and adopts the practice of the selective examination of fire projects kept on records, which lessens the demand for public fire safety and the insufficient fire supervision. Meanwhile it brings about a weak control of fire safety management of some fire projects. The paper suggests that it is an effective way to replace the selective examination of fire projects kept on records by the acceptance review.
