On the Construction of Government Credit in China: A Legal Way

作为"第一信用"的政府信用是社会信用体系的基石,也是法治政府的必然要求——政府信用建设意义重大。目前,政府失信行为在国内引发了信用危机,导致了一系列政府和民众之间的矛盾与冲突。政府信用缺失的分析揭示,法制建设乃关键所在,亟待因应改观。当务之急应当完善政府信用立法,注重在所确立的立法基本原则基础上,对政府信用进行系统化规制,形成立法上配套完整的运行机制,有效保障行政活动得以在阳光下运行。

Government credit, known as ＂the first credit＂, is the basis of social credit system and a necessity for a legal government so that the construction of government credit is of great significance. At present, government dishonest acts have led to the domestic credit crisis as well as a series of contradiction and conflict between the government and the public. The analysis of defect of government credit reveals that the key lies in the legal construction which also asks for perfection. The highest priority now is to perfect the legislation of government credit, regulate government credit systematically based on the basic principles of legislation, set up an operation mechanism with a complete package of legislation and guarantee the administrative activities op- erate under the sunshine.
