论体育赛事民商事法律关系的类型化

Discussion on Classification of Civil and Commercial Legal Relations of Sports Events

运用比较、实证分析、抽象概括等方法,从民商事法律关系视角,审视我国体育产业存在的问题及形成原因。研究认为,体育赛事是体育赛事主体实施的,以提供竞赛产品及相关服务为目的,能够引起体育赛事主体之间民商事法律关系产生、变更和消灭的法律行为。根据体育赛事行为的内在特征,体育赛事民商事法律关系可被类型化为:体育赛事组织法律关系、体育赛事参加法律关系、体育赛事赞助法律关系、体育赛事消费法律关系和体育赛事服务保障法律关系。对体育赛事进行民商法学界定及关系分类,目的在于从产业化、市场化、国际化的角度,构建符合中国国情的体育赛事法律制度,保护和增强我国体育产业的核心竞争力。

Methods such as comparison, positive analysis, and abstractive summarization are a- dopted in this article. From the perspective of the civil and commercial legal relationships to examine the problems of sports industry and their causes. In my opinion, sports events are le-gal acts which are carried out by the subjects of sports events for the purpose of providing the products of sports competitions and concerned services and are able to cause the emergence, change and eradication of the civil and commercial legal relationships among them. The civil and commercial legal relationships of sports events can be classified into ： the legal relationships about organization of sports events, the legal relationships about participation of sports events, the legal relationships about sponsorship of sports events, the legal relationships about con-sumption of sports events, and the legal relationships about service and guarantee of sports e-vents, according to the internal properties of the acts of sports events. This kind of civil and commercial legal definition and classification of sports events aims to construct the legal institu-tions of sports events fit with the circumstances of our country, protect and enhance the core competence of sports industry, and make its due contributions to the development of our econo-my from the perspectives of industrialization, marketization and internationalization.
