The Provisions of the Rights of Faculty and Students in University Charters

师生权利是大学章程制订必然涉及的内容。从欧美等国家一些大学章程中,我们可以发现它们的共同规定性:学术自由是大学师生最核心的权利;师生权利规范的实质在于尊重师生的主体性;大学章程内容应与国家法律法规相统一,权利应与义务相统一。

The rights of faculty and students are unavoidable in establishing a university charter. From the charters of universities in Europe and in the USA, some common provisions are found and conclusions are drawn as follows. Firstly, academic freedom is the core right for faculty and students in universities. Secondly, the essence of regulating the rights of faculty and students lies in respect for the subjectivity of faculty and students. Last but not least, the content of university charters should be consistent with the national law and regulations and rights consistent with duties.
