论我国期货法的立法目的

On Legislative Purpose of Our Futures Act

我国期货市场经历了试点、整顿、规范和发展几个阶段。国务院颁布的《期货交易管理条例》关于期货市场的立法目的的规定以及交易关系和投资者保护等方面的制度设计还存一些不足。总结各国和各地区期货立法经验,并结合我国《证券法》的立法表述,我国未来期货法的立法目的应为规范期货交易行为、保护投资者合法权益、防范市场风险和维护社会秩序以及促进期货市场发展。

Futures market in our country has experienced several development. However, there are inadequacies in the regulation trading stages, trials, rectification, regulation and of legislative purpose of futures market, relationship and investor protection, within Administrative Regulations on Futures State Council. This paper summed up the legislation experiences Trading issued by the of different countries and areas, combining with our legislative expression of our Security Law. The legislative purpose behaviors of futures trading, protect investors＂ legal rights, prevent market of our futures law should regulate risks, maintain social orders and promote the progress of futures market.
