国家与个人理性博弈中的正当防卫理论依据新考

New Investigation on the Self-defense Base Theory According to the State and the Individual Rational Game

正当防卫的立论依据亦即正当防卫的正当性根基。我国通说认为,防卫的权利性乃正当防卫的法理依据。但遗憾的是,通说并没有继续挖掘正当防卫背后隐喻的国家与个人之间的复杂关系,从而掣肘着对正当防卫的法理探索。因此,以社会秩序需求为出发点,以国家与个人的理性博弈为视角,考证正当防卫的立论依据,显得尤为必要。

Self-defense argumenl basis is the legitimacy foudation.It is said in our country that the right of defense is the legal basis of the justifiable defense.But unfortunately,excavation of justifiable defense behind metaphors between the state and the individual complex relationships has not been noticed,thus affect jurisprudential exploration of legitimate defense.Therefore,starting with the social order needs,taking the state and the individual rational game as the angel of view,it is necessary to research the justifiable defense bases.
