研究生科技论文投稿中知识产权问题探析

Discussion of Intellectual Property Issue for Graduate Student Publications

目前,导师、研究生和高校之间在发表论文这一问题上知识产权权属不够明晰。针对研究生作者科技论文投稿中涉及知识产权的问题,介绍了作者署名和排序、著作权的归属、论文发表与专利权、学术剽窃与抄袭行为等方面的法律规定和学术规范。在分析问题产生原因的基础上,探讨了导师、研究生和高校之间避免纠纷和侵权的做法,并从指导研究生正确行使署名权、加强对论文的判断、坚持编辑规范三方面提出了防范知识产权纠纷的编辑处理措施。

At present, it is not clear that whether intellectual property right of publication should be attributed to advisor, graduate students or universities. In order to examine the issue of graduate student intellectual property ownership, this paper gives brief introduction to the by-line and sorting, the ownership of copyright, publication and patent right, as well as legal provisions and academic norms concerning academic plagiarism. Based on our analysis of the causes of these issues, we further discuss how to avoid disputes and infringement in relationship among advisor, student and university. Besides, we propose several countermeasures to guide student exercise their right of signature properly, to reinforce the judgment on paper, and to adhere the editorial standard.
