职业化的法官是现代司法制度合理建构和有效运作的人员基础和构成要素,中国当代司法改革已经形成了以法官职业化为方向的改革思路,法官职业化应该成为中国司法内部人员构造层面改革所恒定坚持的基本立场。法院人员的分类改革是中国当代司法内部人员构造改革的基本前提和切入点,其具有充分的正当性,这种改革的结果将会带来中国当代司法内部新的人员构造格局的形成。

The professionalized judges are the important personnel bases and elements for the reasonable construction and effective operation of modem judicial system, and Chinese contemporary judicature has formed the reform thought with the direction of professionalization of the judges. Even so, the professionalization of the judges should become the constant basic position of the reform of the internal personnel structure of contemporary judicature in China. The classification reform among staffs in courts, which has the significant legitimacy, is the basic premise and breakthrough point of the reform of the internal personnel structure of contemporary judicature in China. As the result of this reform, it will inevitably give rise to the formation of the new personnel pattern in contemporary judicature in China.
