摘要
司法解释可以分为首次解释与再次解释,首次解释具备的与其说是溯及力不如说是确定力,只是将原本模糊不清的法律关系确定化,并不改变原有的法律关系。再次解释应当遵从"从旧原则",一般不得溯及既往。根据制度层面与法理层面的多维分析,《婚姻法》的再次解释如果与旧的司法解释相冲突的话,原则上不应溯及既往,除非原解释表现出恶法特点。
The Judicial Explanation includes first explanation and second explanation. The function of the first explanation is just confirm something rather than retroactivity. It does not change the original legal relation, and only makes unclear legal relation be more clear. The second explanation should obey the doctrine of observing old laws. According to the analysis from rule and principle, if the second explanation of Matrimonial Law conflict with old explanation, it will be not retroactivity as usual, except that old one is a evil law.
