The Relation between the Copyright and Freedom of Expression

表达自由是宪法中的重要价值,它构成了作为部门法的著作权法的基础。著作权法必须依循表达自由的基本价值和规则;另一方面,著作权法则是国家促进表达自由的一项制度安排,通过著作权法制度设计减少作者与公众在表达自由方面的冲突。但是,随着社会的发展,著作权与表达自由的关系也呈现新的矛盾,这一趋势值得我们注意。

Freedom of expression is the important value of constitution and forms the basis of the copyright law, which, as one of department laws, shall follow the fundamental tenor and rule of freedom of expression. Meanwhile, as an institutional arrangement for a nation to promote freedom of expression, the copyright law helps mitigate the conflicts between writers and the public. However, with the development of society, attention must be given to the tendency of new conflicts arising between the copyright law and freedom of expression.
