促进我国产学研合作的法律对策研究

Study on the Legal Countermeasures for Promoting the Enterprise-University-Research Institute Cooperation in China

运用对比分析方法,对国内外产学研合作的法律现状进行比较分析;运用文献研究和实证研究相结合的方法,对影响我国产学研合作的突出障碍和绩效影响因素进行分析;根据现状、障碍和影响因素,从产学研合作中各种社会关系的调整、创新主体的塑造、合作成果的保护和利益分配三个方面分析我国产学研合作的法制需求和立法重点,从完善我国产学研合作法律基础和弥补产学研合作法律空白两个方面提出完善我国产学研合作法律体系的立法构想。本研究将为我国产学研合作立法提供借鉴。

The legal status of Enterprise- University- Research Institute Cooperation at home and abroad was analyzed comparatively. The prominent obstacles which affected the Enterprise - University - Research Institute Cooperation and factors that affect the performance were analyzed using combination method of literature and empirical research. Accord- ing to the status quo, obstacles and factors, the legislation requirement and key point were analyzed from the three as- pects： how to adjusting the social relations during the process of Enterprise - University - Research Institute Coopera- tion; how to shape the innovation participant; how to protect cooperation achievements and allocate the benefits. The legislative conception of Enterprise - University - Research Institute Cooperation was put forward： perfecting the existing legal and supplementing the lack of legal. And the study results would provide a reference for legislation of Enterprise - University- Research Institute Cooperation in China.
