从农村妇女权益保护看村民自治法律制度的完善

On the Perfection of the Legal System of the Villagers' Autonomy from the Protection of Rural Women's Rights

目前,在我国村民自治实践中,出现了对农村妇女财产权、政治权、人身权等保护不力问题,村民自治法律制度不完善是很重要的原因。在村民自治法律制度中,应明确规定确定集体经济组织成员资格的标准、规定集体经济组织成员个人的权利义务,完善村民自治的表决程序、外部行政监督、司法救济途径,进一步保护农村妇女的合法权益,促进农村社会和谐发展。

At present, problems such as the lack of and personal rights arise in the practice of Chinese protection of rural women＇ s property rights, political rights villagers＇ autonomy; and the imperfect legal system of villagers self-government is an important reason. It＇ s should be specified in the legal system of villagers＇ autonomy about the criteria and individual rights and obligations of collective economic organization membership, and improve villagers＇ autonomy＇ s voting procedure, external administration oversight and judicial remedies to further protect the rural women＇ s legal rights and promote the harmonious development of the rural community.
