最高人民法院司法解释权的异化及反思

根据现行中国法律规定,最高人民法院行使对"具体应用法律"的司法解释权。但最高人民法院在行使司法解释权的过程中由行使"具体应用法律"的解释权异化为抽象法律解释的制定权,并不断对现行法律进行漏洞填补、内容更改,成为事实上的立法者,破坏了现行的中国宪政体制,带来了一系列问题。故针对实际情况应将法律解释权统一赋予最高司法机关,在此基础上杜绝其对法律漏洞的填补、修改、废止等立法性工作,同时加强全国人大常委会对最高人民法院司法解释的监督和制定法的立、改、废工作。
