Research into Problems on Anticipated Likelihood

期待可能性理论在德日刑法理论中已取得通说地位,但对于一些具体问题仍然存在激烈的争论,尤其是期待可能性的适用范围和判断标准问题,各种观点分歧较大,未能达成一致意见。从期待可能性的哲学基础来看,它的判断标准应采用行为人标准说;从期待可能性的伦理基础来看,适用范围应是有限制的超法规适用。

Although the theory of anticipated likelihood is accepted at large in criminal law in Germany and Ja- pan, there is a drastic dispute about some concreted problems, especially in the area of the application and the judgment standard. This article first analyzes the problems from the philosophical and ethical point of view and then proposes a new approach.
