生物领域中断言性结论导致的说明书公开不充分问题浅析
摘要
生物领域专利申请说明书中仅给出断言性结论常常导致说明书公开不充分。申请人和审查员之间的争论焦点往往在于对断言性结论和定性实验数据的把握。本文以说明书充分公开的立法宗旨为出发点,结合几个生物领域中的典型案例以及世界各专利局对上述问题的处理思路,简单探讨断言性结论导致的说明书公开不充分问题。
